MYUS Creator Terms
These terms apply when you create, edit, share or sell a character or avatar on MYUS. They are between you and CogsMe Pty Ltd (ABN 71 700 987 935). You accept them when you first apply to be a creator, and again by continuing after any change we notify. They sit on top of the MYUS Terms.
1. Who can create and who can be paid
You must be over 18, have passed the age check, and be on a plan that allows making characters. To be paid you must also pass an identity check, because we send money to a bank account in your name. We keep only the outcome and date of that check, not the documents.
2. What you keep and what you give us
You keep ownership of the text you write. You give us a worldwide, royalty-free licence to host, display, copy, translate and adapt it as the service needs: showing it in the catalogue, sending it to the AI model on every message, translating names and card text into the languages MYUS offers, screening it, and showing it to reviewers. The licence lasts while the content is on MYUS, plus as long as we must keep records under section 8.
Avatars are drawn by a third-party image service from your prompts. You own what you make to the extent the law allows; we make no promise that an AI-generated image attracts copyright, and you must not claim otherwise to a buyer.
A buyer who pays Love Hearts to save your avatar receives a personal, non-transferable licence to keep and use the picture. They may not resell it. If you later withdraw the character, buyers keep what they bought.
3. What you promise about what you submit
Everything you submit is original — yours, not a character, name or world from a film, game, anime, comic or book; depicts fictional adults only — no real person or likeness of one, no one under 18 or written to seem under 18; keeps to our content rules, including consent; contains no photograph of a person; and is lawful in Australia. You confirm this for each character you create or edit, and the confirmation is recorded with a time.
4. Review, publication and removal
Nothing goes live until a person has approved it. We aim to review within three business days but do not promise a time. We may refuse anything, and need only tell you which rule it broke. Editing a live character sends it back to review, and a live listing waits with it. We may remove anything at any time on a report, a change in our rules, or a request from a payment provider or regulator; reports alleging a minor, non-consent or unlawful material hide the content before they are read.
5. Love Hearts, prices and what you receive
Love Hearts are an in-app currency, not money; customers buy them at one cent each or receive them as promotions. You set your prices within the range the app allows. When someone buys, the full price in Love Hearts moves from them to you. When you cash out, each Love Heart is worth 0.9 cents — 90 cents for every dollar a buyer paid — with a minimum payout of $5. We may change the rate for future sales with 30 days' notice, never for Love Hearts you have already earned.
6. Getting paid
Request a payout in the app; we pay by bank transfer or PayID to an account in your name within five business days. Love Hearts leave your balance when the money is sent, not when you ask. You are not our employee or contractor; you are responsible for your own income tax, and for GST if you are registered. Before your first payout you must tell us either your ABN or that you make characters as a hobby and not as a business, and we may withhold from a payment where the law requires it. We may withhold or reverse a payout where a sale is refunded, reversed as fraud, or the content is found to have broken section 3.
7. Ending it
You may stop at any time; withdrawing a listing stops new sales. We may suspend or end your creator account for a breach of section 3, a pattern of reversed sales, or where a provider or regulator requires it. Love Hearts earned honestly before that remain payable; Love Hearts from a reversed sale do not. If your MYUS account is closed, your characters come down.
8. Records and privacy
We hold your chosen creator name, your account identifier, the outcome and date of your identity check, your listings, sales and payout requests, and the review decisions on your work — not your identity documents. Sale and payout records are kept for seven years as tax law requires. See the MYUS Privacy Notice.
9. Liability, law and changes
Nothing here excludes any right you have under the Australian Consumer Law or other law that cannot be excluded. Otherwise, to the extent the law allows, our liability to you under these terms is limited to the Love Hearts owed to you at the time. New South Wales law governs. We may change these terms with notice in the app or by email; changes to the payout rate apply only to future sales.
